TERMS AND CONDITIONS OF PARTICIPATION GENERAL TERMS AND CONDITIONS - Falstaff TRAVEL competition Tirol Spezial-Magazin

1. Registration/participation

To participate in the draw, you must provide at least your first and last name and an e-mail address. The participant is responsible for the accuracy and completeness of this data, in particular the e-mail address.

2. Eligible participants

All persons of legal age and full legal capacity who have correctly completed all the required data and purchased one of the two magazines in the Falstaff Travel Shop as specified are eligible to participate. Employees, authorized representatives, legal successors and agents of the organizer are not eligible to participate.

3. Other conditions of participation

Participation is only possible via the Internet. By purchasing the two items listed on the landing page, the participant agrees to the rules of the competition. Participation is possible within the times specified in the competition, from May 28, 2024 00:00h to June 23, 2024 23:59h.

4. Determination of winnings & participation period

From all participants who have purchased one of the products listed on the landing page between May 28, 2024 and June 23, 2024, the winner will be randomly selected by drawing on June 25, 2024. The winners will then be notified by e-mail to the e-mail address provided and will have 48 hours to claim their prize, after which the claim will expire; in this case, the organizer has the right to award the prize elsewhere / to carry out a new prize draw.

5. Profit

The prize in this competition is a voucher for a wellness vacation for two people for two nights, with Schwarz half board and a welcome drink at Hotel Schwarz in Mieming, which can be redeemed on request and subject to availability. Participants acknowledge that there are certain "blackout dates", i.e. the voucher cannot be redeemed on certain weekends, public holidays and the like. Cash redemption is not possible. The voucher must be given to the hotel at the time of booking.

Not part of the prize and therefore to be borne by the winner are all costs that are not expressly stated by the organizer in these conditions of participation; this includes in particular, but not exclusively, personal expenses, incidental costs, insurance costs, expenses for food and drink or taxes, fees and charges incurred in connection with the claiming of the prize.

The terms and conditions of the hotel and other service providers must be observed by the winner. The provider of the respective service (hotel) is solely liable for all claims arising from the travel relationship. The organizer cannot be held liable for this under any circumstances.

6. Notification of winners

The winner will be notified by e-mail. Notification will be sent to the e-mail address provided; any errors/incompleteness etc. will be at the participant's expense.

7. Applicable law

The competition is subject exclusively to Austrian law to the exclusion of the conflict of law rules of private international law.

8. Transmission of winnings

The prize will be sent directly to the winner's address by the hotel. To this end, however, the participant must agree to provide the organizer with a suitable delivery address. If the winner does not respond within 48 hours of being notified, he/she forfeits any claim to the prize; in this case, the organizer has the right to award the prize to someone else / to carry out a new prize draw

9. Termination options

Falstaff Travel GmbH reserves the right to cancel or terminate the competition at any time without prior notice. This applies in particular if the competition cannot run as planned for any reason, such as software and/or hardware errors and/or for other technical and/or legal reasons that affect the administration, security, integrity and/or regular and proper running of the competition. In such cases, Falstaff Travel GmbH also has the right to modify the competition at its discretion.

10. Privacy policy

10.1 Data collection through participation in the competition

The legal basis for the processing of personal data is Art. 6 para. 1 lit. a GDPR, provided that you have consented to the processing of the data or the processing is necessary for the performance of a contract (Art. 6 para. 1 lit. b GDPR).

If you take part in the competition by registering in accordance with the conditions of participation, the following personal data will be collected, stored, processed and used (collectively "participant data"): First and last name, e-mail address, the IP address and the time of registration.

10.2 Use of participant data in the context of the competition

All participant data will be stored electronically by Falstaff Travel GmbH ("controller" within the meaning of Art. 4(7) GDPR). The winner's personal data will also be passed on to the operators of the Hotel Schwarz/Mieming. Participant data will not be passed on to third parties beyond this.

Your participant data will be treated confidentially, used exclusively for the proper execution of the competition and deleted as soon as it is no longer required for this purpose. If the participant data is subject to retention obligations under tax and commercial law, it will be stored for the duration of the retention obligations of ten years and then deleted, irrespective of the above provision, unless you have consented to storage beyond this or further processing of the data is necessary for the assertion, exercise or defense of legal claims. The legal basis for the processing of personal data for the purpose of fulfilling the statutory archiving and retention obligations is Art. 6 para. 1 lit. c GDPR

10.3 Right to information

Among other things, you have a right to information (Art. 15 GDPR) about the use of your participant data by the organizer. Upon request, you will be provided with complete information about the stored data concerning you at any time and free of charge.

10.4 Right of withdrawal

You can revoke your consent to the use and storage of your participant data at any time without giving reasons (Art. 7 (3) GDPR).

An informal e-mail to the organizer is sufficient for revocation. You can also have your participant data corrected in the same way.

In the event of revocation, your participant data will be deleted immediately. The revocation and the deletion of your participant data will be confirmed to you by e-mail on request.

If the withdrawal is made before the competition has been fully completed, further participation in the competition and, if applicable, the sending of a voucher or prize is excluded. This does not apply if a revocation is only made with regard to the consent to receive marketing messages.

10.5 Other rights in relation to personal data

In addition to the rights to information and revocation set out above, participants have the right to request the correction, transfer, restriction of processing, blocking or deletion of personal data (Art. 16, 17, 18, 20 GDPR).

If you are of the opinion that the processing of your personal data violates applicable data protection regulations or your claims under data protection law have been violated in any other way, you have the right to lodge a complaint with the competent supervisory authority (pursuant to Art. 77 GDPR).

11. Legal process and liability

Legal recourse is excluded. There is no actionable claim to the payment/cash redemption of the prizes. Falstaff Travel GmbH is not liable for the loss, delay, alteration, manipulation and/or misdirection of e-mails and/or data during data entry, recording, transmission and/or storage caused by external data networks, in particular the Internet or the WWW, external telephone lines and/or other hardware and/or software of participants and/or third parties; this also applies in particular to incorrect, missing, interrupted, deleted or defective data. Falstaff Travel GmbH is also not liable for incorrect information caused by participants and/or third parties, their hardware and/or software and which is used for or in connection with the competition. In particular, no liability is assumed if e-mails or data entries do not meet the requirements set out there and are consequently not accepted and/or accepted by the system. Furthermore, Falstaff Travel GmbH shall not be liable in the event of theft or destruction of the systems and/or storage media storing the data or in the event of unauthorized modification and/or manipulation of the data in the systems and/or on the storage media by the participants or third parties. Otherwise, Falstaff Travel GmbH shall only be liable for gross negligence or intentional acts of its legal representatives, employees or vicarious agents. Furthermore, Falstaff Travel GmbH is not liable for damages incurred by the winner or relatives of the winner in connection with the prize. The above exclusion of liability does not apply where liability is mandatory, e.g. in cases of intent, gross negligence, injury to life, limb or health or breach of material contractual obligations. However, the claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability is assumed for intent or gross negligence or due to injury to life, limb or health. A change in the burden of proof to the detriment of the participant is not associated with the above provisions.

12. Severability clause

Should a provision of the conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions. In such a case, the organizer and participants are obliged to cooperate in the creation of provisions that come as close as possible to the economic result of the invalid provision.
